Medical Indemnity Fund Enrollment Forms

Pinnacle Actuarial Services provides independent and quarterly actuarial reports regarding the experience of the New York State Medical Indemnity Fund (MIF). As noted in the most recent quarterly report, the actuarial analysis indicates that the current MIF liabilities exceed the established 80% threshold of the fund’s assets. The calculation to determine fund liability to asset ratio is completed annually and when, as is currently the state, the liabilities exceed the asset threshold, the fund is forced to suspend activity until a financial balance is resolved. Suspension of the fund under these terms is part of a statute required by New York State Public Health Law 2999-I.

In accordance with current statute and regulation, the Medical Indemnity Fund can no longer accept or review applications for enrollment at this time. Furthermore, applications submitted prior to the suspension, but which did not receive notice of acceptance, will be mandatorily denied. It is important to note that suspension of the Medical Indemnity Fund WILL NOT impact payment issuance for qualified plaintiffs already enrolled in the fund. Any future status updates on fund availability will be posted to this website.
