Process for Filling Vacancies
The Executive Secretary regularly monitors the Board's composition to maintain compliance with the Public Health Law. Potential nominees are identified by the Executive Secretary (and/or other DOH staff), Board members, or through a Call for Nominations from stakeholder associations/organizations. The appointment/reappointment process begins several months in advance of a seat becoming vacant to avoid the expiration of the term. In cases where this is not possible (i.e., resignation), the appointment process begins as soon as possible following notification of the resignation.
The Executive Secretary conducts preliminary (internal) vetting for nominees who meet the statutory and additional eligibility criteria adopted by the Board. If the nominee holds a professional license issued by the New York State Education Department, the Office of the Professions' website is reviewed to determine the nominee's status and standing. If the nominee is affiliated with a DOH-licensed facility, the respective Regional Office is notified of the vetting and asked if there are any concerns related to the quality, survey, and complaint history and/or to provide any feedback that would be relevant to the nominee's role as a Board member in the identified seat.
The Executive Secretary contacts nominees who are approved through the preliminary (internal) vetting process by phone regarding the nomination. The Board's responsibilities, the formal vetting process (which includes a background check by the Governor's Office and New York State Police) and state ethics requirements are discussed at that time to formally ascertain the nominee's interest in serving on the Board. The phone contact is followed up in writing, along with a request for identification of the nominee's ethnicity and disclosure of (a) any business relationship with DOH; and (b) any interest, financial or otherwise, direct or indirect, engagement in any business or transaction or professional activity, or obligation of any nature, which is in substantial conflict with the proper discharge of his/her duties as a Board member.
In selecting nominees to advance for formal vetting, every effort is made to ensure geographic, ethnic, and gender diversity on the Board. Council Operations considers geographic representation by the county where the nominee works, not the county where the nominee resides. In the case of Public Representatives, employment is not required. Therefore, geographic representation may be determined by the county where the nominee resides. Selected nominees are advanced for formal vetting through Council Operations.
Upon approval of the nominee(s) by Council Operations, an appointment or reappointment letter is prepared and issued. A thank you letter to the outgoing Board member(s) is also issued
