Accredited Providers & Accreditation Organizations

In accordance with Section 405.1, 10NYCRR, the Commissioner of Health may accept accreditation by accreditation organizations approved by the Centers for Medicare and Medicaid Services (CMS) as evidence of compliance with the minimum Hospital and Diagnostic and Treatment Center operational standards.
Under Section 1865(a) of the federal Social Security Act (SSA), CMS may recognize national accreditation organizations which demonstrate that their health and safety standards and survey and oversight processes meet or exceed those used by CMS to determine a health care facility's compliance with applicable federal Conditions of Participation for the Medicare program.
Section 1865(b)(1) of the Social Security Act provides that facilities are "deemed" if they demonstrate, through the accreditation process, that they meet or exceed all applicable Medicare conditions. The Department conducts follow-up surveys of a sample of deemed providers, per CMS directives, to validate the reviews conducted by accrediting bodies.
